1. Who we are
Gotcha! ("Gotcha", "we", "us") is operated by Gotcha Inc. You can reach us by a direct message to @gotchadotmeme on X.
These Terms of Use ("Terms") govern your use of this website and of the related on-chain programs and public API (together, the "Service"). By connecting a wallet or using the Service, you accept these Terms. If you do not accept them, do not use the Service.
2. What Gotcha is
Gotcha is a launchpad on the Solana blockchain. Anyone can launch a token ("coin") paired with SOL and choose one Pokémon for it. Holders of a coin earn a purchase credit, shown in US dollars, that can be spent on graded Pokémon trading cards or card packs sourced from Collector Crypt.
Gotcha is not a bank, broker, exchange, investment adviser or custodian. Nothing on the Service is an offer of securities, financial advice or a promise of profit.
3. Eligibility
You must be at least 18 years old and legally able to accept these Terms. You may not use the Service if you are located in, or a resident of, a country or region under international sanctions, if you are on a sanctions list, or if using the Service is illegal where you are. You are responsible for complying with the laws that apply to you, including tax laws.
4. Your wallet and profile
You access the Service with a self-custodial Solana wallet (for example Phantom, Solflare or Backpack). You alone control your wallet and its keys. Gotcha never asks for your seed phrase or private key and cannot recover lost funds. Transactions you sign are recorded on the blockchain and cannot be reversed by Gotcha.
The first time you connect, you choose a public @username and sign a message to prove the wallet is yours. Usernames must not impersonate anyone or be offensive; we may change or remove a username that breaks these Terms.
5. Fees
Every trade of a coin launched on Gotcha carries a fee of 2% of the trade amount, split as follows: 60% to the coin's holders (as card credit), 15% to the coin's creator (20% if the creator joined through an invite link) and the rest to Gotcha.
Gotcha's revenue (its share of coin fees, $GOTCHA trading fees, launch fees and boosts) is allocated as follows: 50% to buying $CARDS for $GOTCHA holders, 25% to buying back and burning $GOTCHA and 25% to the treasury, which funds operations and the team.
Launching a coin costs 0.02 SOL plus Solana network fees. Boosting a coin on the Explore page is paid in SOL at the price shown before you sign. We may change fees for the future; changes are announced on the Service and never apply to trades already made. Every fee movement is listed with its transaction on the Proof of fees page.
6. Holder credit
Each hour, the holders' share of a coin's fees is credited to its holders pro rata, based on the lower of each holder's last two hourly balances. Credit is only created from fees already collected.
- Credit is a purchase credit shown in US dollars for convenience. It is not money: it cannot be withdrawn, sold, transferred or exchanged for cash or crypto, and has no value outside the Service.
- Your total credit can be used to open packs. Credit earned on a given Pokémon can be used for cards of that Pokémon. Moving credit from one Pokémon to another costs a 10% conversion fee.
- Credit does not expire today. If that changes, we will announce it at least 30 days in advance.
- We may correct calculation errors and cancel credit obtained through fraud, bots, wash trading, multiple wallets used to game the system, or any breach of these Terms.
7. $CARDS for $GOTCHA holders
Each hour, the $CARDS share of Gotcha's revenue is used to buy $CARDS, the Collector Crypt token, on the open market. It is distributed to $GOTCHA holders pro rata to the lower of their last two hourly $GOTCHA balances and sent automatically to their wallets. Amounts below US$0.50 roll over until they reach that minimum. Gotcha may pay the one-time cost of opening a $CARDS account in your wallet or deduct it from your first payout. Amounts depend entirely on volume and market prices; there is no minimum and no guaranteed amount.
8. Cards and packs
Cards. When you claim a card, Gotcha buys that listing on Collector Crypt and sends the card's NFT to your wallet. Cards are capped at US$10,000 each. The price is fixed when you confirm the claim. If the listing can no longer be bought, your credit is refunded.
Packs. A pack gives one graded card chosen at random by Collector Crypt. The odds shown for each pack come from Collector Crypt and describe the probability of each value range; they are not a guarantee of value.
Collector Crypt. Physical cards are vaulted, insured and redeemed by Collector Crypt under its own terms, which you also accept when you hold, sell or redeem a card. Gotcha is not responsible for Collector Crypt's services.
9. Launching a coin
If you launch a coin, you confirm that you own or have the right to use its name, ticker, logo and description, and that they are not misleading, offensive or infringing. The name, logo and Pokémon chosen at launch are locked forever. You receive your creator share of your coin's trading fees for as long as it trades. We may hide from the Service any coin that is illegal, fraudulent, infringing or harmful; on-chain tokens themselves cannot be deleted.
10. Invites
You can invite people with your personal link. When someone you invited launches coins, you receive 10% of Gotcha's share of those coins' trading fees, for life, paid in SOL once it reaches 0.01 SOL. The person you invited gets a 20% creator share instead of 15%. Self-invites, fake accounts and spam to collect invite rewards are not allowed; we may cancel rewards obtained this way.
11. Risks
Coins launched on Gotcha are highly speculative memecoins. Their price can fall to zero, liquidity can disappear, and smart contracts or third-party services (Solana, Meteora, Jupiter, Collector Crypt, wallets) can fail. $GOTCHA and $CARDS are volatile too. You may lose everything you put in. Past earnings shown on the Service do not predict future earnings. The safety indicators shown on coin pages are automatic checks, not audits or recommendations. Only use money you can afford to lose.
12. What you must not do
- manipulate markets, wash trade or use bots to farm credit or invite rewards;
- use several wallets to get around limits or rules;
- launch coins or pick usernames that impersonate people, brands or other projects;
- attack, overload, scrape abusively or reverse-engineer the Service;
- use the Service for money laundering, fraud or any illegal purpose.
We may restrict access to the Service for wallets that break these rules.
13. Intellectual property
The Gotcha name, logo and site design belong to Gotcha Inc. Pokémon and all related names are trademarks of Nintendo, Creatures Inc., GAME FREAK inc. and The Pokémon Company. Gotcha is not affiliated with, endorsed or sponsored by them. Card images and data come from Collector Crypt and their owners. Gotcha is independent and is not affiliated with, endorsed or sponsored by Collector Crypt.
14. Liability
The Service is provided "as is" and "as available". To the extent allowed by law, Gotcha is not liable for losses caused by market movements, blockchain or wallet failures, third-party services, or your own actions. Our total liability to you is limited to the fees you paid to Gotcha in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law, or your rights as a consumer under the law of the country where you live.
15. Privacy
How we handle data is explained in our Privacy notice.
16. Changes
We may update these Terms. The date at the top shows the latest version, and important changes are announced on the Service. Continuing to use the Service after a change means you accept it. Questions: a direct message to @gotchadotmeme on X.
